Bankruptcy is a legal proceeding governed primarily by Federal law that allows for honest debtors that have been overcome with debts to obtain relief from their creditors. Many factors can cause a debtor to turn to bankruptcy for relief, including the loss of a job, injury or disability, divorce, failed business, and the ever rising cost of debt. Individuals can file a Chapter 7 “straight liquidation” bankruptcy, or a Chapter 13 “debt repayment plan” bankruptcy. The appropriate chapter under which to file depends on the particular circumstances of the debtor, the debtor(s) income, the extent of property owned, the amount of allowable expenses, prior bankruptcy filings, whether or not there is an ability to repay debts, debtor’s goals, and other factors. The Bankruptcy process is started by the Kansas City Bankruptcy Lawyer filing of a Petition in the United States Bankruptcy Court for the district where the debtor resides. Cases can be filed individually or jointly by married debtors. Along with the Petition, the debtors must submit a substantial amount of income, expense, asset, debt, other financial information in a series of schedules and documents also filed with the court. The debtors must also complete a pre-filing credit counseling course and a pre-discharge financial management course. These courses are conducted by court approved third-party providers, and they can be taken in person, over the phone, or over the internet.

After the credit counseling course is completed and all of the documents are filed, a Bankruptcy Trustee is assigned to the case. The job of the trustee is to oversee the administration of the case, conduct a meeting of creditors, examine the debtors about the information that they have submitted to the court, and in a chapter 13, to administer the repayment plan. The case is also assigned to a United States Bankruptcy Judge who will hear disputes between the debtor, creditors, the trustee, and other interested parties. Many cases, however, can be completed without the debtor ever setting foot in a courtroom.

At the conclusion of the case, the debtors will receive a “discharge” of their debts. Generally speaking, the discharge order relieves the debtor from liability for their debts. Note however that not all debts can be discharged by bankruptcy, and the discharge operates differently under different chapters of bankruptcy.
